It’s time for Gov. Mike Dunleavy to take a decisive stand against the growing tyranny of Alaska’s court system. This third branch of government has gone unchecked and unchallenged by the other two branches for decades. It now sees no limit to its powers.

Earlier this month, Superior Court Judge Jennifer Henderson ordered Dunleavy to reverse his veto of $344,000 thousand dollars from the courts 2020 budget because she didn’t like the motivation behind his use of a constitutionally guaranteed power to veto items from the state budget.

So, why did Dunleavy cut the court’s budget?

Because Alaska’s Supreme Court ordered him to spend public money to kill unborn babies.

Dunleavy is a pro-life governor, and he decided to take a symbolic stand last year against judges who think they can order him to pay for something Alaska’s Legislature didn’t authorized.

And the Legislature has made it crystal clear that no state funds can ever be used to pay for elective abortions. Period, the end.

To be clear, his veto did not actually halt state funded abortions. It only reduced the court’s budget by the exact amount which they demand the state spend to underwrite elective abortions. In this regard the veto was only a shot across the court’s bow, and had no real impact on state funded abortions.

But even the suggestion that the executive branch might stand up against the all-powerful court is intolerable to the left – which includes many on the court. And so, the ACLU quickly sprang into action and sued the governor on behalf of the judges – demanding he return their money.

But it gets even worse. Alaska’s Constitution gives the Legislature final authority over the state budget. They hold the purse strings and direct the governor as to how he can and cannot use state funds, and the Legislature has made it crystal clear that no state funds can ever be used to pay for elective abortions. Period, the end. Yet, the courts demand the governor carve out public funds to kill unborn babies in direct violation of the Legislature.

We really have two constitutional issues at play here: The governor’s right to use his veto pen, and the role of the Legislature in approving and directing the use of state funds.

This is a golden opportunity for Dunleavy to uphold his oath to defend Alaska’s Constitution. He may ultimately decide to appeal this ruling to Alaska’s Supreme Court, but he need not. He can simply thank the Superior Court for its opinion on this matter and then side with the Constitution and the Legislative branch, and ultimately the people of Alaska.

This is not about Gov. Dunleavy’s personal feelings on abortion. It’s about defending the Constitution and by extension the right of Alaskans to be governed by the rule of law rather than power hungry justices who believe they are all powerful high priests of The Last Frontier.

They are not. And it’s time for the tall man to stand up for Alaska.

    Spot on Joel, it’s time to stop this overreach and blatant disregard for (ironically) the law by our judicial branch! This is the perfect opportunity for Governor Dunleavy to show us what he’s made of. So far we’re not impressed but it’s certainly not too late to change our minds.

And yes courts and judges, such as Sharon Gleason, Sean Parnell and the corrupt Brady family, just to name a few I have dealt with, have walked all over Alaskan’s for years!! Arrogant sob’s!! The pathetic “Good ol’ boys and girls” can go to hell as far as I’m concerned and I’m sure that’s where they’re headed!! It’s crap like this why we have our Constitution!! Anyone making a living from law and breaks the law or even suggests breaking the law, NEEDS TO BE FIRED AND IF WARRANTED, THROWN IN JAIL FOR DOUBLE TIME!! NOTHING ELSE IS GOING TO STOP THE LAWLESSNESS!! Seen any statues torn down after President Trump mandated Federal Prison!!??

      I don’t know what happened to Master Ray, woman from about eleven years ago, but she was so corrupt, it was pathetic. When you go into a court room and a “judge” asks you how you are going to prove yourself innocent, you know you are in a Kangeroo Court!!

    AWOL Mike would have to come out of his bunker and take the Governorship back from Governor Anne Zink to do all this. So, I won’t be holding my breath for this to happen.

    Joel Davidson, I would suggest we all consider one more constitutionally protected right and liberty in Article IV, Section 1, second sentence. “The jurisdiction of courts shall be prescribed by law.”. For the people of the State of Alaska and the Alaska Legislature, this is the most powerful yet completely underutilized control of the judiciary in our constitution.

    This does appear to be an overreach on the part of the Superior Court. Appropriations are a matter for the Legislature, and the governor has the right to veto appropriations. This should be appealed to the Supreme Court of Alaska to get a reasoned decision on the question.

    I have stated it multiple times the case law and case precedence was set in the U.S. Supreme Court and in state Supreme Court for civil liberties and unconstitutional violations against the the people of the state.
    This case is already won if businesses will unite. There is a Constitutional lawyer ready to take and file in Alaska’s State Supreme Court if you will unite and fight. Alaska is the land of the free and the pioneer spirit that is not not afraid to take on anything at least it sure used to be. Now they cower behind their masks waiting for the next handout while the political officials conspire to steal and embezzle billions to break the country. EVIL CAN ONLY FLURISH WHEN GOOD MEN AND WOMEN COWER AND DO NOTHING!!! As you can clearly see in the Governors office and in the Anchorage mayors office and the Anchorage assemble.
